It's a hysterical rant. Jonathan Kay, for all the ink that he gets to throw around, has no idea what Section 13 is all about.
Just to give you one other example of stuff he's misread, one of his earlier editorials on the topic has him declaiming that "antisemitsm is no longer a problem in Canada."
And this was published while Apartheid Israel week "festivities" were underway at several campuses in Eastern Canada.
People should take the time to actually go and read some of the decisions that have come in under Section 13. Nearly always it's about reining in violent monsters and pathological maniacs and cynical hateful con-artists like Zundel.
It's been well and truly suggested that the Levant and Maclean's cases are very unlikely to hold water and not typical or suitable Section 13 cases; and this has been asserted over and over again by organizations like B'nai Brith and CJC and SWC that have invested money and legal expertise in intervening in several critical section 13 actions over the years.
At the heart of Kay and Levant's and Maclean's aversion to the legislation is that they want a free pass for media when it comes to human rights issues, that no one should be able to to sue a media for defamation unless they have the millions of dollars and top lawyers or own an equally large printing press....
And there's no excuse for crawling into bed with neo-Nazis like Lemire over this.
The Nazis are just falling over themselves laughing as they reel suckers like Kay and Levant in on this petard of "journalistic freedom."
